Welcome to FounderVision. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our service.

These Terms constitute a legally binding agreement between you and Sintetico Inc. ("Sintetico," "we," "us," or "our") regarding your use of FounderVision.

By creating an account or using FounderVision, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Description of Service

FounderVision is an AI-powered business conversation platform that helps evaluate and develop business ideas through interactive conversations. Our service includes:

  • AI-powered conversations to explore your business concept
  • Real-time dialogue with intelligent follow-up questions
  • Automated generation of business insights and summaries
  • Conversation history and documentation
  • Assessment reports for internal evaluation

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without notice.

Account Registration and Security

Registration Requirements

To use FounderVision, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Verify your email address
  • Maintain the security of your password
  • Accept responsibility for all activities under your account

Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information remains current and accurate
  • All activities that occur under your account

We will never ask for your password via email or phone. If you receive such a request, do not respond and contact us immediately.

Acceptable Use

When using FounderVision, you agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload or share malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Use automated tools to access the service (bots, scrapers, etc.)
  • Reverse engineer or decompile any part of the service
  • Impersonate another person or entity
  • Harass, abuse, or harm others
  • Share false, misleading, or fraudulent information
  • Use the service for any illegal purpose
  • Interfere with or disrupt the service or servers
  • Collect user information without consent

We reserve the right to investigate violations and take appropriate action, including account termination and legal action.

Intellectual Property Rights

Our Intellectual Property

FounderVision and all related content, features, and functionality are owned by Sintetico Inc. and are protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or create derivative works
  • Sell, rent, lease, or sublicense the service
  • Remove or alter proprietary notices
  • Use our trademarks without permission

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use FounderVision for your personal or business purposes, subject to these Terms.

User-Generated Content

Your Content

You retain ownership of the business ideas and information you share during conversations ("Your Content"). By using FounderVision, you grant us a license to:

  • Process Your Content through our AI services
  • Generate summaries and assessments based on Your Content
  • Store Your Content on our servers
  • Display Your Content to you and authorized administrators

Content Responsibility

You are solely responsible for Your Content and represent that:

  • You have the right to share the information
  • Your Content does not violate any laws or third-party rights
  • Your Content is accurate to the best of your knowledge
  • You will not share confidential information belonging to others without authorization

Do not share sensitive personal information (SSN, financial account numbers, health records, etc.) during conversations. Focus on your business concept and relevant professional background.

AI Services and Limitations

AI-Generated Content

FounderVision uses artificial intelligence to conduct conversations and generate insights. You understand and agree that:

  • AI responses are generated by algorithms and may not always be accurate
  • AI-generated assessments are for informational purposes only
  • AI insights should not be considered professional business advice
  • You should verify all information and consult with qualified professionals
  • We do not guarantee the accuracy, completeness, or usefulness of AI-generated content

Not Professional Advice

FounderVision does not provide legal, financial, tax, or professional business consulting advice. The insights and summaries generated by our AI are for general informational purposes only and should not be relied upon as professional advice.

Always consult with qualified professionals (lawyers, accountants, business consultants) before making significant business decisions.

Fees and Payment

FounderVision is currently provided free of charge. We reserve the right to introduce paid features or subscription plans in the future.

If we introduce paid features, we will provide advance notice and allow you to decide whether to continue using the service under the new terms.

Termination

Termination by You

You may terminate your account at any time by contacting us at support@foundervision.org or through your account settings.

Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • Your account remains inactive for an extended period
  • We are required to do so by law
  • We discontinue the service
  • We reasonably believe your account poses a security risk

Effect of Termination

Upon termination:

  • Your access to the service will be immediately revoked
  • We may delete your account and data after a reasonable retention period
  • You remain responsible for any obligations incurred before termination
  • Provisions that by their nature should survive will continue to apply

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including:

  • Merchantability and fitness for a particular purpose
  • Non-infringement of third-party rights
  • Accuracy, reliability, or completeness of content
  • Uninterrupted, secure, or error-free operation
  • Correction of defects or errors
  • Freedom from viruses or harmful components

We do not warrant that the service will meet your requirements or that AI-generated insights will be accurate or useful for your business.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SINTETICO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes damages for:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or business information
  • Business interruption
  • Reliance on AI-generated content
  • Cost of substitute services
  • Any other commercial damages or losses

Our total liability for any claims arising from your use of FounderVision shall not exceed the amount you paid to us in the twelve months preceding the claim (currently $0).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Sintetico Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

  • Your use or misuse of the service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your Content or business ideas
  • Any misrepresentation made by you

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

Informal Resolution

Before filing a claim, you agree to contact us at legal@foundervision.org to attempt to resolve the dispute informally.

Binding Arbitration

If we cannot resolve a dispute informally, any claims will be resolved through binding arbitration in Miami, Florida, in accordance with the rules of the American Arbitration Association.

Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.

Modifications to Service

We reserve the right to:

  • Modify or discontinue any aspect of the service
  • Change features, functionality, or availability
  • Update these Terms at any time
  • Introduce new terms for new features

We will provide notice of material changes by posting the updated Terms with a new "Last Updated" date. Your continued use after changes constitutes acceptance of the new Terms.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sintetico Inc. regarding FounderVision.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
